After a trial spanning over 15 years, the court granted the accused the benefit of the doubt, citing a severe lack of reliable and cogent evidence presented by the prosecution to prove its case beyond reasonable doubt.<br>Special Judge A.K. Lahoti, in his judgment, underscored several critical failures on the part of the prosecution. <\/p>\n\n\n\n<p class=\"\">A central point was the inability to establish a definitive link between the motorcycle used in the blast and Pragya Singh Thakur. The court noted that the chassis number of the alleged blast motorcycle had been wiped out, and there was no conclusive or reliable evidence presented to prove that Pragya Singh Thakur owned the vehicle or was in its possession immediately before the blast. The court also observed that she had reportedly embraced a life of a sanyasi (renunciant) two years prior to the blast, distancing herself from material possessions, which further weakened the prosecution&#8217;s claim.<\/p>\n\n\n\n<p class=\"\"><br>The court&#8217;s verdict highlighted numerous deficiencies and irregularities in the investigation and prosecution&#8217;s approach. These included:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">Absence of crucial evidence: No fingerprints or data dumps were collected from the blast site.<\/li>\n\n\n\n<li class=\"\">Improper crime scene management: The court noted that the blast site was not properly barricaded, leading to contamination of the crime scene and undermining evidence collection. No sketch of the spot was done by the investigating officer during the panchnama.<\/li>\n\n\n\n<li class=\"\">Inconclusive forensic reports: Samples were found to be contaminated, rendering forensic reports inconclusive and unreliable.<\/li>\n\n\n\n<li class=\"\">Defective sanction orders for UAPA: The court ruled that provisions of the Unlawful Activities (Prevention) Act (UAPA) were not applicable due to defective sanction orders. Sanction under Section 197 of the CrPC was also not required.<\/li>\n\n\n\n<li class=\"\">Lack of proof for conspiracy and RDX storage: The court found no credible evidence to prove alleged conspiracy meetings among the accused or that RDX was stored, procured, or assembled at Lt Col Prasad Purohit&#8217;s residence, as claimed by the ATS.<\/li>\n\n\n\n<li class=\"\">Discrepancies in victim counts: The court found manipulations in some medical certificates and concluded that the number of injured persons was 95, not 101 as initially claimed by the prosecution.<br>The court unequivocally stated that while a blast did occur in Malegaon on September 29, 2008, resulting in six fatalities and injuries to 95 people, the prosecution failed to establish that the bomb was specifically planted in the recovered motorcycle or that explosives were stored or assembled by the accused. Judge A.K. Lahoti emphasized that &#8220;mere suspicion cannot take the place of real proof&#8221; and that &#8220;terrorism has no religion, but the court cannot convict on mere perception.&#8221;<br>The accused, who also include Major (retd) Ramesh Upadhyay, Ajay Rahirkar, Sameer Kulkarni, Sudhakar Chaturvedi, and Sudhakar Dhar Dwivedi, were acquitted of all charges under the UAPA, Arms Act, and various sections of the Indian Penal Code, including charges related to committing a terrorist act, criminal conspiracy, murder, and promoting enmity between religious groups.<br>This verdict concludes a high-profile and deeply sensitive terror trial that had been ongoing for nearly 17 years and was investigated by both the Maharashtra Anti-Terrorism Squad (ATS) and later the National Investigation Agency (NIA). The initial ATS probe had attributed the blast to a Hindu right-wing outfit, Abhinav Bharat. Over 320 prosecution witnesses were examined during the trial, with 34 turning hostile, significantly weakening the prosecution&#8217;s case.<br>Families of the victims have expressed their disappointment with the judgment and have stated their intent to appeal in a higher court to seek justice. Meanwhile, some of the acquitted, including Pragya Singh Thakur, have spoken about the immense personal toll the prolonged trial took on their lives.
