{"id":8985,"date":"2026-08-11T16:37:12","date_gmt":"2026-08-11T16:37:12","guid":{"rendered":"https:\/\/indianinsightnews.com\/?p=8985"},"modified":"2026-08-11T16:37:15","modified_gmt":"2026-08-11T16:37:15","slug":"vande-mataram-gets-legal-shield-blocking-its-singing-can-now-invite-3-year-jail-term","status":"publish","type":"post","link":"https:\/\/indianinsightnews.com\/?p=8985","title":{"rendered":"Vande Mataram Gets Legal Shield; Blocking Its Singing Can Now Invite 3-Year Jail Term"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><strong>President Droupadi Murmu gives assent to amendment Bill; repeat offenders face minimum one-year imprisonment; national song to be sung at Red Fort on Independence Day<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>NEW DELHI:<\/strong> National Song <strong>\u2018Vande Mataram\u2019<\/strong> has been brought under legal protection comparable to that available to the National Anthem <strong>\u2018Jana Gana Mana\u2019<\/strong>, with President <strong>Droupadi Murmu<\/strong> giving her assent to the <strong>Prevention of Insults to National Honour (Amendment) Bill, 2026<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With the President\u2019s approval, the amendment to the 1971 law has come into force, making the deliberate obstruction of the singing of Vande Mataram, or preventing an assembled gathering from singing it, a punishable offence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the amended law, a person found guilty of deliberately preventing the singing of Vande Mataram or disrupting an assembly engaged in singing it may face <strong>imprisonment of up to three years, a fine, or both<\/strong>. A repeat offender will be liable to a <strong>minimum one-year jail term<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Parliament clears Bill in two days<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The amendment was passed by both Houses of Parliament last month. The <strong>Rajya Sabha cleared the Bill on July 29<\/strong>, followed by the <strong>Lok Sabha on July 30<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legislation seeks to amend <strong>Section 3 of the Prevention of Insults to National Honour Act, 1971<\/strong>, extending specific statutory protection to the National Song against deliberate disruption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The amendment is being seen as an attempt to address the gap in the existing law, under which there were specific provisions dealing with disruption of the National Anthem but no comparable provision expressly covering Vande Mataram.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Union Minister of State for Home Affairs <strong>Nityanand Rai<\/strong>, while responding to the debate in Parliament, described the measure as reflecting the country&#8217;s national consciousness, cultural heritage and the ideals of the freedom struggle.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cThe amendment is not merely a legislative change but shows the collective commitment to India&#8217;s national consciousness, cultural heritage, and the ideals of the freedom struggle.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\">Deliberate disruption to be a criminal offence<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The amended provision specifically targets deliberate interference with the singing of Vande Mataram.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This includes preventing the song from being sung and obstructing a gathering that has assembled for its singing. The offence carries a maximum punishment of three years&#8217; imprisonment, a fine, or both.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a subsequent conviction for the same offence, the law prescribes a minimum imprisonment of one year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Importantly, the provision concerns <strong>deliberate obstruction of the singing<\/strong>. It should not be interpreted as automatically making every instance of an individual not singing Vande Mataram a criminal offence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Six stanzas and a three-minute-ten-second official version<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The legal amendment comes against the backdrop of a detailed protocol issued by the <strong>Union Ministry of Home Affairs (MHA)<\/strong> on the singing and playing of Vande Mataram.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The official protocol specifies the version of the National Song to be used at official functions. The complete version comprises <strong>six stanzas and has a duration of approximately three minutes and 10 seconds<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The MHA has also laid down the order to be followed when Vande Mataram and Jana Gana Mana are both part of the same official programme.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Vande Mataram first, Jana Gana Mana next<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">At official functions where both the National Song and the National Anthem are to be performed, <strong>Vande Mataram will be sung or played first, followed by Jana Gana Mana<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The protocol also calls upon those present to stand in attention and maintain due respect while the National Song and National Anthem are being performed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The government has said that the protocol is intended to ensure uniformity in the manner in which Vande Mataram is performed at official functions across the country.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Special significance for schools and institutions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Centre has also sought to give Vande Mataram greater prominence in educational institutions and public programmes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is to encourage a sense of national consciousness among students and strengthen respect for national symbols and institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The guidelines form part of a broader effort by the Union government to establish a uniform protocol governing the performance of the National Song.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Historic Independence Day at Red Fort<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The new legal protection will coincide with a significant change in this year&#8217;s Independence Day celebrations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the <strong>first time, Vande Mataram is scheduled to be sung from the ramparts of the Red Fort in Delhi on August 15, 2026<\/strong>, as part of the country&#8217;s 80th Independence Day celebrations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The inclusion of the National Song at the iconic Independence Day ceremony is expected to give the celebrations added historical and symbolic significance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Red Fort has traditionally been the centrepiece of India&#8217;s Independence Day programme, with the Prime Minister addressing the nation from its ramparts following the hoisting of the national flag.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A song rooted in the freedom struggle<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Written by <strong>Bankim Chandra Chattopadhyay<\/strong>, Vande Mataram occupies a significant place in the history of India&#8217;s freedom movement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The song became one of the most powerful symbols of India&#8217;s nationalist movement and was widely used during the struggle against British rule.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On <strong>January 24, 1950<\/strong>, Constituent Assembly President <strong>Dr Rajendra Prasad<\/strong> stated that Jana Gana Mana would be the National Anthem while Vande Mataram would be accorded equal honour and status as the National Song.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The latest legislative move provides Vande Mataram with a specific statutory safeguard against deliberate disruption.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">From national symbol to statutory protection<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The 2026 amendment marks a significant development in the legal framework governing India&#8217;s national symbols.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While Vande Mataram has long enjoyed official recognition as the National Song, the new law provides a specific criminal-law mechanism against deliberate obstruction of its singing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The combination of a formal performance protocol, statutory protection and its scheduled inclusion in the Independence Day ceremony at the Red Fort is expected to give Vande Mataram a more prominent place in official national functions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The development also adds a new chapter to the long history of a song that emerged from India&#8217;s freedom struggle and continues to occupy a distinctive position in the country&#8217;s national tradition.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Droupadi Murmu gives assent to amendment Bill;
