New Delhi:<\/strong> The debate over the Uniform Civil Code (UCC) has gained fresh momentum following the announcement that the NDA-ruled states will move towards implementing a common civil code before 2029.<\/p>\n\n\n\n

The Uniform Civil Code seeks to replace religion-based differences in personal laws governing matters such as marriage, divorce, maintenance, adoption, guardianship and inheritance with a common set of civil rules applicable to all citizens.<\/p>\n\n\n\n

However, an important distinction needs to be made: there is no single nationwide UCC in force yet.<\/strong> The exact provisions would depend on the legislation adopted by individual states. Uttarakhand, which implemented its UCC on January 27, 2025, currently provides the most important state-level model for understanding the possible changes.<\/p>\n\n\n\n

What Could Change for Muslim Families?<\/strong><\/h2>\n\n\n\n

Muslim personal law is likely to see some of the most significant changes if a UCC based on the Uttarakhand model is adopted.<\/p>\n\n\n\n

Polygamy<\/strong><\/h3>\n\n\n\n

One of the major changes could be the introduction of monogamy as a common civil-law requirement<\/strong>. Under the Uttarakhand UCC framework, polygamy is prohibited.<\/p>\n\n\n\n

This would mean that a person could not legally maintain more than one marriage at the same time, irrespective of religion.<\/p>\n\n\n\n

Divorce<\/strong><\/h3>\n\n\n\n

Muslim personal-law practices relating to divorce would be brought under a common legal framework. Divorce procedures and grounds would be governed by civil law rather than differing according to religion.<\/p>\n\n\n\n

Maintenance<\/strong><\/h3>\n\n\n\n

Maintenance provisions for spouses and children could also become uniform, removing religion-based differences in the applicable legal framework.<\/p>\n\n\n\n

Inheritance<\/strong><\/h3>\n\n\n\n

Inheritance is potentially one of the most significant areas of change.<\/p>\n\n\n\n

At present, Muslim inheritance is governed substantially by Muslim personal-law principles. A UCC could replace religion-specific succession rules with a common succession framework<\/strong>.<\/p>\n\n\n\n

The precise distribution of property, however, would depend on the provisions of the final legislation.<\/p>\n\n\n\n

\n\n\n\n

What Could Change for Hindu Families?<\/strong><\/h1>\n\n\n\n

UCC would not be a law affecting Muslims alone. It would also change the legal framework applicable to Hindu families.<\/p>\n\n\n\n

Hindu family law is currently governed by statutes including:<\/p>\n\n\n\n

  • Hindu Marriage Act<\/li>\n\n\n\n
  • Hindu Succession Act<\/li>\n\n\n\n
  • Hindu Adoptions and Maintenance Act<\/li>\n\n\n\n
  • Hindu Minority and Guardianship Act<\/li>\n<\/ul>\n\n\n\n

    If a common civil code is introduced, several religion-specific provisions could be replaced or modified by common rules.<\/p>\n\n\n\n

    Marriage and Divorce<\/strong><\/h3>\n\n\n\n

    Hindu marriages would continue to be capable of being solemnised according to religious customs, but their legal validity, registration and related civil rights could be governed by common rules.<\/p>\n\n\n\n

    Divorce procedures could similarly be brought under a uniform framework.<\/p>\n\n\n\n

    Inheritance<\/strong><\/h3>\n\n\n\n

    The present Hindu succession framework could be replaced or modified by common succession provisions applicable irrespective of religion.<\/p>\n\n\n\n

    This could have a direct impact on how property is inherited and divided within Hindu families.<\/p>\n\n\n\n

    Adoption<\/strong><\/h3>\n\n\n\n

    A common adoption framework could allow people of different religions to follow the same statutory procedure for adopting children.<\/p>\n\n\n\n

    \n\n\n\n

    What Could Change for Christian Families?<\/strong><\/h1>\n\n\n\n

    Christian marriages and divorces are currently governed by specific legislation, including the Indian Christian Marriage Act, 1872<\/strong>, and the Divorce Act, 1869<\/strong>.<\/p>\n\n\n\n

    Under a UCC, several of these religion-specific provisions could be replaced by common civil rules.<\/p>\n\n\n\n

    Possible areas of change include:<\/p>\n\n\n\n

    • Marriage registration<\/li>\n\n\n\n
    • Grounds and procedures for divorce<\/li>\n\n\n\n
    • Maintenance<\/li>\n\n\n\n

    • Inheritance and succession<\/li>\n<\/ul>\n\n\n\n

      Religious wedding ceremonies could continue, while the legal consequences of marriage would be governed by the common civil framework.<\/p>\n\n\n\n

      What Could Change for Sikhs?<\/strong><\/h1>\n\n\n\n

      The legal position of Sikhs is somewhat different from that of Muslims and Christians.<\/p>\n\n\n\n

      Several central personal-law statutes use a legal definition of \u201cHindu\u201d that also covers Sikhs, Buddhists and Jains<\/strong> for specified purposes.<\/p>\n\n\n\n

      Consequently, Sikh family law does not operate entirely through a separate comprehensive personal-law code comparable to Muslim personal law.<\/p>\n\n\n\n

      Under a UCC, the principal change would therefore be a transition from the existing personal-law framework to a common civil-law framework<\/strong> covering:<\/p>\n\n\n\n

      • Marriage<\/li>\n\n\n\n
      • Divorce<\/li>\n\n\n\n
      • Maintenance<\/li>\n\n\n\n
      • Adoption<\/li>\n\n\n\n
      • Guardianship<\/li>\n\n\n\n
      • Succession<\/li>\n<\/ul>\n\n\n\n

        This does not necessarily mean that Sikh religious marriage ceremonies would disappear. The distinction is between religious customs and the civil-law consequences of marriage<\/strong>.<\/p>\n\n\n\n

        \n\n\n\n

        What Could Change for Buddhists?<\/strong><\/h1>\n\n\n\n

        Buddhists, like Sikhs and Jains, are covered by certain Hindu personal-law statutes for legal purposes.<\/p>\n\n\n\n

        A UCC could therefore replace that existing framework with a common set of rules applicable to citizens regardless of religion.<\/p>\n\n\n\n

        The major areas affected could include marriage, divorce, adoption, guardianship and inheritance.<\/p>\n\n\n\n

        Again, the exact impact would depend on the final legislation enacted by the relevant state.<\/p>\n\n\n\n

        What Could UCC Mean for Women?<\/strong><\/h1>\n\n\n\n

        Supporters of the UCC argue that one of its biggest advantages would be greater gender equality in family law<\/strong>.<\/p>\n\n\n\n

        For Muslim women, possible changes include common rules on marriage, divorce, maintenance and inheritance.<\/p>\n\n\n\n

        For Hindu women, changes could arise in succession, marriage, divorce, adoption and guardianship.<\/p>\n\n\n\n

        Christian women could see changes in divorce, maintenance and succession provisions.<\/p>\n\n\n\n

        Sikh and Buddhist women could also be affected as their existing personal-law framework is replaced or modified by common civil provisions.<\/p>\n\n\n\n

        However, it would be inaccurate to claim that UCC automatically means women will receive greater property rights in every circumstance. The actual impact will depend on the specific succession and property provisions contained in the final UCC legislation.<\/strong><\/p>\n\n\n\n

        \n\n\n\n

        What About Men?<\/strong><\/h1>\n\n\n\n

        UCC would also impose common legal obligations on men.<\/p>\n\n\n\n

        These could include:<\/p>\n\n\n\n

        • Compliance with common marriage rules<\/li>\n\n\n\n
        • Common divorce procedures<\/li>\n\n\n\n
        • Maintenance obligations<\/li>\n\n\n\n
        • Common inheritance rules<\/li>\n\n\n\n
        • Adoption and guardianship requirements<\/li>\n<\/ul>\n\n\n\n

          Thus, UCC is not simply a reform aimed at one religious community or at women alone. Its broader objective is to establish a common civil-law framework irrespective of religious identity<\/strong>.<\/p>\n\n\n\n

          Why Uttarakhand Matters<\/strong><\/h1>\n\n\n\n

          Uttarakhand is currently the most important example in India’s UCC debate.<\/p>\n\n\n\n

          Its UCC came into force on January 27, 2025<\/strong>, introducing common provisions concerning marriage, divorce and succession. It also created a legal framework for the registration of live-in relationships.<\/p>\n\n\n\n

          The Uttarakhand experience is therefore likely to influence discussions in other states considering similar legislation.<\/p>\n\n\n\n

          However, other states may adopt provisions that differ from the Uttarakhand model.<\/p>\n\n\n\n

          \n\n\n\n

          The Constitutional Question<\/strong><\/h1>\n\n\n\n

          The UCC debate is closely linked to Article 44 of the Constitution<\/strong>, which directs the State to endeavour to secure a Uniform Civil Code for citizens throughout India.<\/p>\n\n\n\n

          At the same time, Article 25 protects freedom of religion<\/strong>, making the balance between religious freedom and uniform civil law an important constitutional question.<\/p>\n\n\n\n

          The central issue is therefore not simply whether there should be a common civil code, but also how far such a code can regulate family matters while respecting religious freedom, cultural practices and constitutional protections.<\/strong><\/p>\n\n\n\n

          \n\n\n\n

          What Will Actually Change?<\/strong><\/h1>\n\n\n\n

          The most important principle behind UCC is the movement from:<\/p>\n\n\n\n

          \u201cDifferent personal laws based on religion\u201d<\/strong><\/p>\n\n\n\n

          to<\/p>\n\n\n\n

          \u201cCommon civil rules applicable irrespective of religion.\u201d<\/strong><\/p>\n\n\n\n

          If UCC legislation is introduced across more NDA-ruled states, it could represent one of India’s most significant reforms of family and personal law since Independence.<\/p>\n\n\n\n

          But the precise consequences for Muslims, Hindus, Christians, Sikhs and Buddhists will depend on the wording of each state’s legislation.<\/p>\n\n\n\n
