Centre Tightens Social Media Regulations; Rule Amendments to Take Effect from February 20.

New Delhi:
The Central Government has announced stricter regulations for social media platforms by introducing amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. The revised rules will come into force on February 20, 2026.

Key Changes

🔹 3-Hour Takedown Rule:
Under the amended rules, social media intermediaries must remove unlawful content within three hours of receiving official notice from the competent authority. Previously, platforms were allowed up to 36 hours for compliance.

🔹 Mandatory Labelling of AI and Deepfake Content:
Platforms are now required to clearly label AI-generated, synthetic, or deepfake content. The move aims to curb misinformation and prevent the misuse of emerging technologies.

🔹 Increased Platform Accountability:
The amendments strengthen compliance obligations for intermediaries. Failure to act within the stipulated time may result in the loss of “safe harbour” protections, potentially exposing platforms to legal liability.

Government’s Rationale

Officials said the amendments are intended to enhance digital safety, curb the rapid spread of misinformation, and address growing concerns over manipulated content created using artificial intelligence.

Digital rights experts and civil society groups have expressed concerns over the feasibility of the three-hour compliance window and its possible impact on freedom of expression. Some argue that expedited takedown requirements may lead to over-censorship.
